Who I am
This website, constancekennedy.com, is owned and operated by Constance Drapeau Kennedy, doing business as Constance Kennedy Photography, in Marshfield Hills, Massachusetts. For many years this business operated as The Welcome Gallery, and some of my earlier work is credited to Connie Drapeau Kennedy. Those are the same business and the same photographer. The address thewelcomegallery.com now brings you here, and The Welcome Gallery archive of client galleries remains available under this policy.
Seeing Goodness, my mindfulness and photography practice, is also mine, but it has its own website and its own privacy policy. If you follow a link from this site to Seeing Goodness or to its Substack newsletter, that policy applies once you arrive.
What I collect, and why
I collect as little as I can. What I do collect comes to me in a few ways.
When you fill out the contact form or email me, I receive your name, your email address, and whatever you choose to tell me about the photographs you have in mind.
When you become a client, I collect the information needed to do the work: your name, contact details, a mailing address for prints and albums, the details of your session, and answers to any questionnaire I send. Contracts and invoices are handled through my studio software, described below.
When you view a client gallery, the gallery records your name and email address, and if you place an order through it, your order and shipping information.
When you meet me in person, at an open house, an exhibit, a business or community event, or a similar occasion, you may enter a raffle, sign a guest book, or hand me your business card. Unless you tell me otherwise, I'll keep your name and contact information, which may be entered into my contact list and studio software, and I may use it to let you know about things like a grand opening, an exhibit, or a new offering. I do this rarely, and only with people who have given me their information; I do not send email to people who haven't, and I do not buy, sell, rent, or trade what you give me. You can ask to come off my list at any time, and I'll take you off.
Who helps me run this business
Like most small studios, I rely on a handful of companies to host this website, deliver your photographs, and keep my records in order. Each of them holds some of your information in the course of doing that work, and each has its own privacy policy, linked here.
PhotoBiz hosts this website and delivers contact-form submissions to me. [link]
PhotoShelter hosts my client galleries and The Welcome Gallery archive. Print orders are usually placed directly with me, but a gallery can also take an order and payment through PhotoShelter's own processor, and on the rare occasions that happens, PhotoShelter holds the order and shipping details. 17hats is my studio management system, where contracts, invoices, questionnaires, scheduling, and much of my client email live. If you receive an invoice or a reminder from me, it likely came through 17hats. [link]
Payments are processed by Square, or by Stripe through 17hats. I never see or store your card number. [links]
Email. My email is hosted by Google and, for some correspondence, by Apple.
Google Analytics tells me, in aggregate, how visitors find and use this site and the gallery site. See "Cookies" below. [link]
Substack delivers the Seeing Goodness newsletter, if you have subscribed to it. [link]
Editing and design tools. I edit and retouch photographs with professional software from companies including Adobe, Capture One, DxO, Topaz Labs, and Evoto, and design albums with tools such as Fundy Designer. Some of these process image files on the company's servers as part of their work. None of them receive your name or contact information from me.
Print and album labs. When you order prints, albums, or wall art, I share your name, shipping address, and the images to be printed with the lab producing the order. I work with a small number of professional labs, currently including Miller's Professional Imaging, ACI Lab, and WHCC. Labs change over time; the same practice applies to each.
I do not share your information with anyone else, except where the law requires it.
Cookies
This site and my client gallery site use Google Analytics, which places small files called cookies in your browser so that I can see, in aggregate, how people find and move through the site: which pages are visited, roughly where visitors are located, and what kind of device they use. I do not see who you are. Analytics shows me counts and patterns, not names, email addresses, or anything that identifies an individual visitor, and I do not use it for advertising. You can decline cookies in your browser settings or install Google's Analytics opt-out browser add-on, and the site will work either way. PhotoBiz and PhotoShelter may also set cookies necessary for the site and galleries to function, such as keeping you logged in to a private gallery.
Your photographs
You are the subject of the photographs, and I take that seriously.
Client galleries are private, reachable only by link or password, and are shared only with you and the people you choose to share them with.
I sometimes show client work in my portfolio, in the Journal on this site, in exhibits, and in my Seeing Goodness writing. I do this only with a signed model release or your written permission, and you can say no without it affecting our work together. If you have given permission and later change your mind, tell me and I will remove the image from my websites and social media, though I cannot always recall printed or previously published material.
I do not publish photographs of children without the written permission of a parent or guardian.
Photographs I make are protected by copyright, which I retain, and are delivered to you under the terms of your agreement with me.
Your choices and your rights
You may ask me at any time what information I hold about you, ask me to correct it, or ask me to delete it. I will honor those requests except where I need to keep a record, for example a signed contract or a tax record, for as long as the law requires. If you are visiting from a place with its own privacy laws, such as the European Union or California, those laws may give you additional rights, and I will do my best to honor them.
If you subscribed to the Seeing Goodness newsletter, you can unsubscribe through the link in any issue. For anything else, just ask.
Security
I use reputable, well-established services and take reasonable care with your information, but no website or system can be guaranteed completely secure, and I cannot promise otherwise.
Changes to this policy
I may update this policy as my tools or practices change. When I do, I will change the effective date at the top. Changes apply going forward, not to information collected before them.

Questions about this policy or your information are welcome.
